Privacy Policy

This Privacy Policy explains how KMC Holding LLC (“Komicha,” “we,” “us”) collects, uses, and shares information when you use komicha.com and related services (the “Service”). The Service is for adults only (18+). By using the Service you agree to this Policy.

1. Information We Collect

  • Account information. Your email address and sign-in verification codes, managed through our authentication provider, and any profile details you choose to add.
  • Content you create. Your chat messages, prompts, persona details, story choices, and the AI-generated conversations and images produced in your sessions. Your conversations are private to your account; they are not visible to other users.
  • Payment information. If you purchase a subscription, our payment processor collects your payment details under its own privacy policy. We receive transaction records (such as plan, amount, and status) but never your full card number.
  • Usage and device information. Log data such as IP address, browser type, pages viewed, feature usage, and approximate location derived from IP (used, among other things, to apply regional availability and legal requirements).
  • Cookies. We use cookies and similar technologies for sign-in sessions, preferences, security, and analytics. Your browser can limit or block cookies, though sign-in may stop working without essential cookies.

2. How We Use Information

  • Provide, personalize, and maintain the Service;
  • generate AI responses and images in your sessions (see Section 3 for the processors involved);
  • process payments and manage subscriptions;
  • enforce our Terms and Content & Acceptable Use Policy, including detecting attempts to generate prohibited content and suspected underage use;
  • comply with legal obligations and respond to lawful requests;
  • communicate with you about your account, and — with the ability to opt out — about new features and offers;
  • debug, secure, and improve the Service.

3. Your Conversations

We do not use your conversation content to train AI models. Your chats and generated scenes are used to operate the Service for you — not as training data.

To generate responses and images, your prompts and relevant conversation context are processed by the AI infrastructure providers listed in Section 4, under agreements that restrict their use of the data to providing the service to us. Komicha staff do not read your conversations except in limited circumstances: with your explicit consent (for example, a support request), for safety and abuse review when content is flagged by our systems or reported, or as required by law.

4. How We Share Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only with:

  • Service providers that process data on our behalf: cloud hosting and authentication (Google Cloud / Firebase), AI text-generation providers, AI image-generation providers, email delivery, analytics, and payment processing. Providers are bound by contracts limiting their use of your data;
  • Legal and safety recipients, where required by law or where we believe disclosure is necessary to protect users, the public, or the Service — including reports of apparent child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) as required by federal law;
  • Corporate transactions — a merger, acquisition, or asset sale, in which case this Policy continues to apply to previously collected data.

5. Retention and Deletion

We keep your information for as long as your account is active and as needed to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. You can delete individual conversations in the app, and you can request deletion of your account and associated data by emailing support@komicha.com from your account email. We will delete or de-identify your data within a reasonable period, except where retention is required by law (for example, transaction records or safety reports).

6. Your Privacy Rights

Depending on your state (including under the California Consumer Privacy Act as amended by the CPRA, and similar laws in other states), you may have the right to: know and access the personal information we hold about you; correct inaccurate information; delete your information; obtain a portable copy; and not receive discriminatory treatment for exercising these rights. We do not sell personal information or share it for cross-context behavioral advertising, so there is nothing to opt out of on that front; we also honor Global Privacy Control signals. To exercise any right, email privacy@komicha.com from your account email. We will verify your request and respond within the time required by law. You may use an authorized agent where the law allows; if a request is denied, you may appeal by replying to our decision.

7. Adults Only — No Children

The Service is restricted to users 18 and older. We do not knowingly collect information from anyone under 18, and we do not direct the Service to children. If we learn that a user is under 18, we will terminate the account and delete its data. If you believe a minor has used the Service, contact privacy@komicha.com.

8. Security

We use industry-standard safeguards — encryption in transit, access controls, and staff access restrictions — to protect your information. Given the personal nature of conversations on the Service, we treat chat content with heightened access controls. No system is perfectly secure; please use a strong, unique password for your email account, which controls sign-in to Komicha.

9. International Users

The Service is operated from the United States and intended for US users. If you access it from elsewhere, you understand your information will be processed in the United States.

10. Changes and Contact

We may update this Policy; material changes will be announced by email or prominent notice on the Service before taking effect. Questions and requests: privacy@komicha.com.
